TERM OF SALE

All RIAD MAGDA customers acknowledge having the capacity to contract under the conditions described in the conditions of sale presented below, that is to say, the legal majority and not to be under guardianship or guardianship. As such, he acknowledges having read these conditions of sale before placing his order. Therefore, taking an order entails full adherence to the conditions of sale and their unreserved acceptance.

Administrative conditions:

Passport in process of validation.
Police card to be completed on arrival with a copy of the passport for each person.

Article 1 – Prices:
1.1 – Our prices include:

The rental of the room,
The provision of bed and bath linen,
Breakfast,
Unlimited access to WiFi internet,
Access to the satellite TV package,
Access to the swimming pool,
Access to the hammam (subject to a notice period of 2 hours for heating),
The provision of spring or mineral water in the rooms.

Our rates indicated on the website and all documents produced by the Riad are expressed in euros, 10% VAT (ten percent) included. Invoicing is carried out in Moroccan dirhams, it being specified that the exchange rate applied is 1 (one) euro = 11 (eleven) Moroccan dirhams.

As part of a room reservation, our rates are based on occupancy of the room by 2 (two) people maximum. For the “KENZA” AND “SALMA” AND “SAKEENA” and “JENNA” rooms, a 3rd (third) person may occupy the room for an additional charge of 59 euros per adult and night. For all rooms, a high-quality baby bed with suitable bed linen can be made available for an additional charge of 05 euros per cot and per night sofa bed child under 12 years old 29 € / night,

As part of a privatized reservation of the Riad, our prices are established based on occupancy of the Riad by 10 (ten) people maximum. Considering that the prestige rooms “KENZA” AND “SALMA” AND “SAKEENA” and “JENNA” can accommodate a 3rd guest, an 11th and a 12th up to the 14th person can occupy the privatized Riad for additional invoicing of 50 euros per person and per night. In any case, a privatized reservation of the Riad is strictly limited to accommodating a maximum of 14 people. A high-quality cot with suitable bed linen can be made available for an additional charge of 5 euros per cot and per night.

1.2 – Our prices do not include in particular:

The municipal tourist tax (see article below),
The tourist promotion tax (see article below),
Lunches and dinners,
Cold or hot drinks taken apart from those offered for breakfast,
Massages (by appointment),
Airport / Riad / airport transfers,
Other transfers, visits, excursions, activities & ancillary services, etc …
The provision of a cot (see article above),
Any visa fees,
Insurance of any kind,
Tips,
Personal expenses,
More generally, all the services, activities & services not mentioned in the chapter “the prices indicated above include”.

1.3 – Local tourist taxes:

Our Riad having the status of “Guest House”, it is legally obliged to invoice its customers, in addition to its services, the following 2 (two) tourist taxes:

  • The Tourism Promotion Tax (TPT) in the amount of 11 (eleven) dirhams per person per night,
    The Communal Stay Tax (TCS) in the amount of 15 (fifteen) dirhams per person per night.

These taxes are respectively paid in full to the Moroccan National Tourist Office and the Municipality of Marrakech. The amount of the aforementioned taxes is subject to change without notice according to the instructions sent by the administrations concerned

Article 2 – Reservations:
2.1 – Reservations outside “Privatized Riad”:

For any reservation, the customer is responsible for the costs of internet access and use of the site or when calling the site reservations department. When booking, the customer agrees to provide the information that will be requested and agrees to the veracity of the latter:

Names and first names of all occupants,
Residence address,
Landline and mobile phone number,
E-mail address,
Type of payment card, card number, expiration date, and cryptogram,
Means of transport used and contact details for return flights,

Any reservation only becomes firm and final upon receipt of a deposit of 50% (fifty percent) of the total amount of the nights booked. This deposit must be paid by credit card, bank transfer, or any other means of payment accepted or recommended by the company RIAD MAGDA.

The deposit of 50% (fifty percent) on the booking must be paid within a maximum of 8 clear days from the date of booking, failing which, the company RIAD MAGDA reserves the right to re-let the room (s). reserved.

In the event of an online reservation (via the internet), the deposit of 50% (fifty percent) of the total amount of the nights reserved will be payable at the time of the reservation action.

The balance of the rental of the room (s) as well as the local tourist taxes and all the possible “extras” (lunches, dinners, drinks, services, optional services not included in the rental price of the room) will be invoiced at the time. of the end-of-stay check-out and will be payable in cash (in euros or Moroccan dirhams) or by credit card (VISA, VISA PREMIER, EUROCARD / MASTERCARD, EUROCARD / MASTERCARD GOLD) with an increase of 5% (five percent) for interbank fees, taxes, and commissions.

The customer receives electronically (if possible) a confirmation of your reservation, including essential elements such as identification of the room (s) reserved, dates, prices, payment terms, and cancellation conditions, etc.

2.2 – “Privatized Riad” reservations:

For all reservations, customers bear the costs of internet access and use of the site or when calling the site reservations department. When booking, customers agree to provide the information that will be requested of them and agree to the veracity of the latter:

Names and first names of all occupants,
Address of residence of all occupants,
Landline and mobile phone number of all occupants,
Email address of all occupants,
Name & first name of the Group Manager in charge of contacts with the RIAD MAGDA,
Type of payment card, card number, expiration date, and cryptogram,
Means of transport used and contact details of participants’ return flights.

It is expressly stated that the privatization of the Riad is only possible for a minimum stay of 3 (three) nights. The number of people accommodated in the privatized Riad cannot in any case exceed 12 (twelve).

The reservation of the privatized Riad becomes firm and final only upon receipt of a deposit of 100% (one hundred percent) of the total amount of the nights reserved. This deposit must be paid by credit card, bank transfer, or any other means of payment accepted or recommended by the company RIAD MAGDA.

The deposit of 100% (one hundred percent) at the reservation of the privatized Riad must imperatively be paid within a maximum period of 8 clear days from the reservation, failing which, the company RIAD MAGDA reserves the right to re-let all the rooms of the Riad.

Article 3 – Cancellations:

Cancellation de votre réservation commande pour quelle que raison que ce soit ne vous dispense pas du paiement intégral des sommes dont vous êtes redevable auprès de la société RIAD MAGDA. Dans ces conditions, la société RIAD MAGDA conseille vivement à ses clients de contracter une assurance annulation ou d’utiliser la couverture annulation de leur carte VISA PREMIER ou GOLD MASTERCARD. En règle générale les modifications, quelles qu’elles soient, sont traitées comme une annulation suivie d’une nouvelle commande, entraînant les frais d’annulation en vigueur.

En cas d’annulation pour quelle que cause que ce soit, les frais extérieurs au forfait et d’ores et déjà engagés par le client (délivrance des visas, autres documents de voyage, frais de vaccination…) ne peujet faire ‘un quelconque remboursement.

3.1 – Cancellation scale for reservations outside “Privatized Riad”:

Cancellation fees are those applied when a customer cancels their reservation:

more than 60 days before arrival: 50 (fifty) euros per room,
60 to 15 days before arrival: 50% (fifty percent) of the total amount of nights booked,
less than 15 days before arrival or no-show: 100% (one hundred percent) of the total amount of nights booked.

3.2 – Cancellation scale for “Privatized Riad” reservations:

Cancellation fees are those applied when a customer or a group of customers cancels their reservation:

more than 90 days before arrival: 250 (two hundred and fifty) euros for the Riad,
90 to 61 days before arrival: 50% (fifty percent) of the total amount of nights booked,
60 to 30 days before arrival: 75% (seventy-five percent) of the total amount of nights booked,
less than 30 days before arrival or no-show: 100% (one hundred percent) of the total amount of nights booked.

The aforementioned cancellation costs will be settled by the partial or total non-refund of the deposit paid and, if necessary, by the debit card of the additional balance.

These cancellation costs may be covered by cancellation insurance if this was taken out by the customer when making their reservation.

No refund will be granted if, for any reason whatsoever, the customer does not show up at RIAD MAGDA on the dates and times of his reservation, or, abandons the stay in progress, or, renounces the services included in the stay sold. Likewise, if the client cannot present the police or health documents required for his trip (passport, identity card, visa, vaccinations, etc…).

Article 4 – Complaints:

Any complaint about non-performance or improper performance of the services covered by the reservation must be reported on-site by the customer to the manager of the RIAD MAGDA, explaining his grievances to him within 24 (twenty-four) hours of his arrival. If the customer has not obtained satisfaction, he must present his complaint in writing and send it by registered mail with acknowledgment of receipt within a maximum period of 30 (thirty) clear days from the date of return to SARL RIAD MAGDA – 87, Derb El Halfaoui – Bab Doukkala – 40000 MARRAKECH – MOROCCO. Article 5: Responsibility:

5.1 – General:

For the purchase of a service or a subcontracted service such as transfer, excursion, car rental, external activity and service, and more generally any service provided by the non-salaried staff of the company RIAD MAGDA, this the latter acts as a simple intermediary between you and the service provider. The company RIAD MAGDA cannot answer for any reason whatsoever for the responsibility which falls exclusively on these service providers.

RIAD MAGDA takes particular care in choosing its suppliers. In the event of non-performance or improper performance of any element included in its service, the responsibility of the company RIAD MAGDA can not be engaged, if this non-performance or improper performance is attributable to the customer, to a case of force majeure, or to the unforeseeable fact. and insurmountable, from a third-party foreign to the provision of the planned services.

5.2 – Relating to the use of the swimming pool:

Customers are informed that the RIAD MAGDA swimming pool is not supervised by a Lifeguard. Therefore, the company RIAD MAGDA particularly draws the attention of its customers to the fact that swimming is practiced there at the risk and peril of bathers.

For children, the RIAD MAGDA swimming pool, which is not equipped with barriers, fences, covers, alarm systems, or other special safety devices, can constitute a serious danger. 5.3 – Relating to the use of the hammam:

RIAD MAGDA customers are informed that for security reasons:

Access to the hammam is prohibited for people under 18 (eighteen) years old, even accompanied.
the use of the hammam is not recommended for pregnant women or people suffering from cardiac or cardiovascular ailments, hypotension or hypertension, venous or respiratory pathologies, acute infections, angina, nasopharyngitis, asthma, during convalescence from an infectious disease (viral hepatitis, toxoplasmosis, infectious mononucleosis, kidney disease, etc.) or any other medical contraindication.

Article 6: Miscellaneous provisions:

6.1 – Photographs, videos & illustrations:

We make every effort to provide customers with photos, videos, and illustrations that give the user an overview of the services offered. The purpose of these photos, videos, and illustrations is to indicate to the user the category or degree of comfort but cannot commit RIAD MAGDA beyond this purpose.

6.2 – Taking possession and release of the room:

Customers are informed that the rules applicable to international hotels require that customers take possession of the rooms from 2 p.m. regardless of the time of arrival of the flight and vacate them before 10 a.m. regardless of the time. of the return flight.

6.3 – Information on formalities for individual travelers:

A customer is considered to be traveling on an individual basis as long as he is not traveling through a tour operator. In this case, presentation to the emigration authorities of a valid passport with an expiration date of at least 6 (six) months after the return date is COMPULSORY, including for children.

The tourist stay is limited to 3 (three) months. Certain nationalities are subject to obtaining a visa, it is up to the client to inquire at the Moroccan consulate in his country of residence. Moroccan law prohibits hotels, guesthouses, and riads from receiving unmarried Muslim nationals.

Article 7: Special situations:

At the time of booking, the customer must draw the attention of the company RIAD MAGDA to any particular matter which may affect the course of the stay. Consequently, the company RIAD MAGDA reserves the right to refuse the reservation on the day of departure or to interrupt the stay to any person whose behavior, behavior, physical or mental state would be likely to affect the smooth running of the trip. stay. Article 8: Customer behavior:

The behavior of RIAD MADGA customers must not offend or undermine good morals, the peace, and quiet of other customers as well as the cleanliness of the spaces made available to them.

Minor children are placed under the supervision of their parents or those who have custody of them. Whether accompanied or not, their parents are responsible for any damage they may cause.

In order to ensure the health and tranquility of everyone within the Riad, the following rules must be applied. It is strictly forbidden: to damage the buildings, to cross the security guardrails, to enter the corridors or service areas, to use radios or other sound instruments, to introduce animals into the Riad, to feed the animals, smoke inside the covered facilities, introduce or consume illicit substances throughout the Riad, introduce weapons or dangerous objects that could frighten or injure other people, s ” indulge in any ostentatious behavior, all political, religious and philosophical manifestations as well as an act of proselytism whatsoever.

In addition, clients of the RIAD MAGDA must maintain throughout their stay, appropriate clothing so as not to infringe modesty and good morals.

Finally, it is strictly prohibited to allow non-clients of the establishment to enter the Riad without the express authorization of the Riad Manager.

Failure to comply with the recommendations and prohibitions detailed above may lead the Manager of the Riad to take any appropriate measure to ensure full compliance with these recommendations and prohibitions, which may go as far as expulsion without reimbursement or compensation. no sort.

Article 9: Attribution of the jurisdiction in the event of a dispute:

The parties agree to submit all disputes related to the application of these general conditions of sale to the Courts of Marrakech.
